1. License for Show Usage
All shows purchased from Visaudio Designs are licensed for one competitive season only. A competitive season is defined as the duration of a single performance calendar year in a formal competitive environment, such as WGI, DCI, or local circuits.
If you wish to use the show beyond the initial competitive season—whether for competition, performance, or non-competitive purposes—you must acquire an additional license. This includes, but is not limited to, the use of the show in exhibitions, rehearsals, or any other public performances outside the initial season.
Failure to secure an extended or additional license constitutes a breach of this agreement and may result in legal action.
2. Music Copyright and Intellectual Property
All music compositions, arrangements, sound designs, and show designs provided by Visaudio Designs are protected under copyright law. Visaudio Designs retains all rights to the intellectual property of the shows and music. When you purchase a show, you are obtaining a limited license to use it, not ownership of the material itself.
Prohibited Activities:
- You may not copy, distribute, or modify any part of the music or design without prior written permission from Visaudio Designs.
- Reselling or sharing the show materials with other organizations or entities is strictly prohibited.
- Recording and distributing performances of the show (e.g., posting videos online) may require separate permissions depending on the music’s publishing rights. It is your responsibility to ensure compliance with all applicable performance and recording rights for the copyrighted music used in the show.
3. Copyright and Licensing Fees
By purchasing a show, you acknowledge that additional licensing fees may apply for:
- The use of music not composed or owned by Visaudio Designs, which may require separate licensing from performing rights organizations (e.g., ASCAP, BMI, SESAC) or direct from the music publisher.
- Any broadcast, live stream, or recorded distribution of the performance.
Visaudio Designs makes every effort to ensure compliance with copyright laws and expects the same from all clients. We can assist in obtaining any necessary licenses, but it is ultimately your responsibility to secure the appropriate permissions for music usage, especially if recorded or distributed.
4. Termination of License
Visaudio Designs reserves the right to terminate any license granted under these terms if there is any misuse or violation of the licensing agreements. Continued use of a show after the license expires, without renewal or obtaining an extended license, is strictly prohibited and may result in legal action.
